Standard

Access

AT&T will provide Customer with a copy of the AT&T Global Network Client (the "Client"), which includes an end user Program License Agreement. The term Client includes the original version and release thereof and any revisions, enhancements, updates, or the like and all whole or partial copies of it, including modified copies or portions merged into other programs. Customers are responsible for providing a copy of the Client to each of their Users of AT&T Business Internet Services (corporate dial).

Connection to AT&T Business Internet Services corporate dial is accomplished by placing a local phone call or an "800" number (toll free) call (where available and subject to surcharge) to one of the designated Points of Presence (POPs). In addition, users may access AT&T Business Internet Services through an ISDN connection to the network through a fee "800" number (toll free) (where available) or a local call in selected cities, at ISDN rates as specified in the applicable Schedule of Charges. Dial access charges are computed using 36 second increments for each dial access session. Customers must use the ISDN fee "800" number in the United States when attempting to bundle two or more ISDN B channels during an ISDN dial connection under AT&T Business Internet Service. The designated local ISDN numbers support only a single ISDN B channel. ISDN charges are incurred for the total amount of B channel time during a connection. Please refer to the Billing section for a detailed example of ISDN charges.

AT&T Global Network Client

Version 6.0 of the Client contains encryption technology that may be subject to limitations on its importation and/or use in various countries around the world. Due to such limitations, the Version 6.0 Client may only be imported and used in the following countries:

Notwithstanding the foregoing, Customer is responsible for complying with all applicable local laws and/or regulations relating to the importation and use of technology (including the Client) into each country where the Client is deployed by Customer. The listing of the countries above are only applicable to the AT&T Business Internet Service. Further and/or additional restrictions may apply for other AT&T services. Other limitations on Intensive Use as part of the Service may apply in certain countries and Customer should consult the applicable section of the Service Guide for such limitations.

In addition to the rights set forth in the Agreement, AT&T hereby grants to Customer a worldwide, limited, paid-up, revocable license to reproduce and distribute to Users that are authorized to use the Service. The Customer must assure that its Users agree to the terms and conditions contained in the AT&T Program License Agreement, a copy of which is available at http://www.attbusiness.net/terms/pla.html and which is also contained in the Client. The Client is not sold. Title to the Client does not pass to Customer or any User. Customer may not sublicense, rent, lease, modify, translate, make derivative works of or assign the Client.

In the event that Customer and/or Users wish to access the Service in countries not listed above where AT&T or its suppliers provide the Service, a version of the Client that does not contain encryption technology is also available. This version of the Client may not, however, allow Customer and User to access all Features or functions of the Service, including the Wi-Fi Feature, the Wired Ethernet Feature and the Personal Firewall Option.

The Client contains code designed to collect connection performance information for use by AT&T. Such information includes, but may not be limited to, information about the operating system and modem Customer's Users are using, the local service provider POP number dialed, calling line information (unless blocked by User), IP address, account identification and user identification, and connection error code information.

Unless otherwise set forth in Customer's contract, AT&T will provide helpdesk support to Customer and its Users to assist in identifying connectivity problems related to the Client. In the event that the Client creates errors in operation that prevent Customer from accessing a material portion of the Service and AT&T is able to replicate such errors, AT&T will use commercially reasonable efforts to correct such errors by providing a patch, bypass or update. AT&T's obligation to correct such errors is conditioned on: (i) Customer's use of a currently supported version and release of the Client; (ii) Customer's use of an operating system ("OS") that is supported by the version and release of the Client at issue; and (iii) the failure resulting from errors in the Client and not in other applications or the OS.

When Customer is no longer using the Service, Customer shall destroy all copies of the Client and, upon AT&T's written request, certify such destruction.

User IDs

User IDs may not be shared.

In order to simplify the administration of Customer's account, a separate Addendum is not required if Customer subsequently decides to add additional user IDs for the same plan in such country; instead, such additions shall be subject to the terms of the Attachment, any Addendums and any related documents. Customer must indicate the order for such additional User IDs via email or otherwise as a country may specify. However, a new Addendum is required if Customer wishes to: (1) add or modify any Services (other than by adding user IDs as described above) set forth herein; or (2) add Services or items not set forth herein.

User IDs must be registered within a country where AT&T offers the Service and where the User resides.

User IDs that have not been used for an extended period of time may be deleted. AT&T will provide Customer with its current User ID and Re-Use policy upon request.

Application parameters and/or programs may not be used to avoid the inactivity time-outs which are part of the Service. In addition, multiple simultaneous connections or concurrent usage of a single User ID for any monthly plan Users is not permitted. AT&T will immediately terminate any session where these activities are detected and may immediately suspend or terminate any User ID which engages in such activities.

AT&T Traveling User Support Option

A. For certain Services, as specified in the applicable sections of the Service Guide, out of region roaming, also referred to as the "AT&T Traveling User Support Option," is intended to allow Users to access the Service when traveling to selected countries where there is a relationship established with Affiliates and other local service providers. The Traveling User Support Option provides remote terminal access using supported terminal devices in the countries that support global network traveling Users. Users of the Traveling User Support Option are charged on an hourly basis when they connect to AT&T's network from a region different than where they are registered for the Service. AT&T has currently defined five regions: (1) Asia Pacific ("AP"), (2) Europe, Middle East and Africa ("EMEA"), (3) Latin America (South America, Central America, Caribbean and Mexico), (4) North America (U.S., Canada) and (5) China. AT&T may change or modify the countries contained in these regions, or add or delete regions, at its option and in its sole discretion, immediately upon posting such changes to this Service Guide.

B. AT&T will provide Customer a list of the Affiliates and other local service providers and the terminal devices and emulation Software supported upon Customer's request.

C. The Traveling User Support Option is intended to allow Customer or Users to access the Service on an occasional basis when You or Users travel outside of the home country of Customer's Service. If Customer needs access to the Service from a location outside of Customer's home country for an extended period, for example, longer than a month of consecutive use or more than three months in a year, Customer must obtain a local account ID and User ID from the AT&T entity in that country. AT&T reserves the right to further define what constitutes occasional use and may revise these guidelines from time to time immediately upon posting such changes to the Service Guide.

D. Customer is responsible for local country dial telephone access charges as applicable. Customer will also incur the applicable charges that are associated with the application, and services Customer uses. Customers will incur the applicable roaming charges when accessing AT&T managed dial facilities in regions other than the home region where the User ID is registered.

E. The Traveling User Support Option is not available in all countries where AT&T provides the Service, notwithstanding the fact that telephone numbers for certain local service providers in such countries may be listed in the Client used with the Service. Currently, the Traveling User Support Option is not available in the following countries: Bulgaria, Pakistan, Poland and the Russian Federation. AT&T, at its sole discretion, may add or remove countries where the Traveling User Support Option is available without prior notice to Customer. Customer may not use the Traveling User Support Option in any countries where it is not currently available.

Optional

Third party authentication server

AT&T Business Internet Services (corporate dial) supports previously approved, customer-implemented RADIUS technology (where available) as an alternative method of authentication to the standard Service Manager RACF password authentication. The RADIUS authentication takes place on the customer-provided RADIUS server located on the customer site. The installation, operation and maintenance of the RADIUS server are a Customer responsibility. Certain components of the AT&T Business Internet Services are not available to RADIUS users, including POP3 Internet mail and personal web space.

There is an additional one-time third party authentication server charge for each RADIUS server.

POP3 Internet Mail

AT&T Business Internet Services (corporate dial) includes the option of POP3 Internet mail accounts with up to 12 megabytes of storage per user. If a user's mailbox has not received mail within the last 90 days and the user has not accessed their mailbox within the past 90 days, then AT&T will delete the entire contents, if any, of the user's mailbox.

Unless the Custom Mail Domain option described below is selected, each Customer's mail domain defaults to a network address of AT&T's sole choosing.

Customer Selected Custom Mail Domain

Optionally, for an additional one-time setup charge, the mail domain may be customized and AT&T will register a customer's choice of domain with the appropriate registering body if it is not already taken. Customers are responsible for any resulting registration fees.

AT&T Business Internet Services (corporate dial) Web Mail Feature

Web mail is an e-mail facility that allows users to access their e-mail from virtually any computer connected to the Internet. Normally, when users check their e-mail, the e-mail is downloaded to the user's e-mail client and cleared from AT&T's mail servers. With Web Mail, users can view and respond to their e-mails and each e-mail will remain on AT&T's servers until the user specifically deletes the e-mail. Web Mail is available under the Base, Intermediate, Enterprise and Account Cap Plans. There is no additional charge for the Web Mail feature.

AT&T Business Internet Services (corporate dial) Spam Control Feature

The Spam Control Feature is designed to help customers manage unsolicited commercial e-mail (commonly referred to as "spam"). Currently, AT&T uses a third party vendor to identify potential spam. When potential spam is identified based on a set of rules supplied by such software, an e-mail will be sent to the User's mailbox with an indication that a certain email is a "Spam email." Such User can then decide how to handle that piece of mail. The Spam control feature currently employs the Brightmail® Anti-Spam solution. Brightmail is a registered trademark of Brightmail Inc. This solution works without any e-mail message being read. The Spam Control Feature is not flawless in its operation and may not detect all unsolicited commercial e-mail. In addition, some e-mail identified as potential spam may not, in fact, be unsolicited commercial e-mail. It is the customer's responsibility to determine if the feature should be activated for its individual users and to ultimately determine how to handle each e-mail received by its users. However, if Customer elects to activate this feature, then the feature will be activated for all of its Accounts and Users of the Services specified in the Sales Order. Instructions are available on the use of this feature at http://www.attbusiness.net. There is no additional charge for the Spam Control Feature.

Personal Web Space

Personal Web Space is available for those AT&T Business Internet Services Customers who want to create their own web space. They are given 10 MB of storage. Customer's domain name will be http://www.pws.prserv.net/account.userid where "account" is Customer's account ID and "userid" is Customer's user ID. Customer can also change Customer's home page URL to something other than Customer's account and User ID by using the Customize Your URL tool in Account Center. For example, Customer can change http://pws.prserv.net/usinet.joedoe to http://pws.prserv.net/joesdiner.

Fenced Internet

Fenced Internet allows Customer to limit the access of their users to a predefined set of sites. Customer provides AT&T the IP addresses of the sites that the users are authorized to access. Attempts to access sites that are not on the authorized list will denied. There are no additional charges associated with the use of this service option.

AT&T Extended Access Feature ("Extended Access"), Wi-Fi Access Feature ("Wi-Fi Feature"), and the AT&T Wired Ethernet Feature ("Wired Ethernet Feature")

Solely for use by U.S. Customers with U.S. registered User IDs ONLY

Definitions

"AT&T Wired Ethernet Feature" means the access to the Service by Customer or Users via Wired Ethernet connections provided by AT&T's suppliers.

"AT&T Wi-Fi Feature" means the access to the Service by Customer or Users via HotSpots chosen by AT&T and provided by AT&T's suppliers.

"Connectivity Features" refers collectively to the AT&T Wi-Fi Feature and the AT&T Wired Ethernet Feature.

"Extended Access Feature" means the access to the Service by Customer or Users via dial connections provided by AT&T's suppliers.

"HotSpot" means an 802.11 Wi-Fi platform point of presence for wireless fidelity Internet access. A HotSpot is a Wi-Fi POP.

"LAN" means a local area network, used in conjunction with the AT&T Wired Ethernet Feature.

"POP" means a Point of Presence where the Service is made available to Customer via dial connectivity, Wired Ethernet Connections/POPs, or a Wi-Fi.

"Region" or "Zone" means the area where a POP is located, for billing purposes.

"Unit" means hardware equipment that User supplies and uses to access the AT&T Wi-Fi Feature and the AT&T Wired Ethernet Feature, including, but not limited to a computer, personal data assistant, any 802.11b Wi-Fi compliant card, Ethernet card or the like.

"Wi-Fi", or Wireless Fidelity, means the IEEE 801.11b specification that uses the 2.4 GHz frequency to allow wireless Internet connectivity using transmission speeds up to 11 Mbps between a Unit and a HotSpot.

"Wi-Fi Session" means a 24 hour consecutive period of time that begins when a User logs in to the Service via a Wi-Fi hotspot and ends 24 hours thereafter. User can log in and out of the same hotspot within the 24 hours and will only be charged for one session. A Wi-Fi Session may not exceed 24 hours.

"Wired Ethernet Connections" are cable connections utilizing the IEEE 802.3 standard that provide broadband data transport capabilities.

"Wired Ethernet Day" means a 24 hour session measured from first login at the same hotel venue.

Description of the Extended Access and Connectivity Features

Customers appropriately registered in selected countries may utilize the Extended Access and the Connectivity Features. The Extended Access Feature adds dial access capability for traveling users, including additional countries through the use of a third party relationship. Through its Affiliate AT&T Global Communications Services Inc., to whom AT&T has assigned this portion of the Service for Users registered in the United States, AT&T provides both the Extended Access Feature and the Connectivity Features to Customers. The Extended Access Feature and the Connectivity Features utilize POPs from locally authorized ISPs in the countries where these portions of the Service are available. The Extended Access Feature and the Connectivity Features are only provided via POPs that are owned and operated by non-AT&T Affiliate third party entities. AT&T has no control nor provides any management or oversight of such third party POPs. The Fenced Internet Option is not available with Extended Access and the Connectivity Features. Extended Access and the Connectivity Features are not available to those customers that do not use the AT&T Global Network Client to access the Service.

In order to gain access to the POPS in the countries available with the Extended Access or the Connectivity Features, the individual User will be required to upgrade to version 6.0 or later of the AT&T Global Network Client, which contains the proper interface for use with the Extended Access Feature and the Connectivity Features. To download the AT&T Global Network Client, go to ftp://ftp.attglobal.net/pub/client/win32/nvsetup.exe.

In order to see Extended Access numbers displayed in this version of the Client, Customer must make an initial connection to a standard AT&T POP (non-Extended Access number), and Customer's User ID must be enabled for the Extended Access feature. The phone list is updated on AT&T servers every week, but only pushed down to Customer's Client every 30 days. AT&T suggests that Customer retrieve the most current phone list before traveling by selecting the menu arrow and then checking for updates once the Client is launched.

Access speeds are dependent upon the quality of the telephone line, LAN, Wired Ethernet Connection or HotSpot and the equipment located in such countries. A list of the cities, phone numbers, HotSpot and locations of each POP will be identified in the then current software-based phone book available from AT&T for use with the Extended Access Feature and the Connectivity Features, which list may be updated from time to time without prior notice to Customer. Service level objectives and agreements (SLAs) are not applicable to the Extended Access Feature and the Connectivity Features. Token authentication services and devices may not work with the Extended Access Feature and/or the Connectivity Features. ISDN access is not available with the Extended Access Feature.

Customer may only make use of the Extended Access Feature and/or the Connectivity Features via the POPs that AT&T makes available with the Service. Customer may not use Extended Access Feature or the Connectivity Features via any other POPs, and AT&T may charge Customer additional amounts on the basis of the costs and expenses that AT&T incurs in connection with Customer's usage of the Extended Access Feature or the Connectivity Features at any other such POPs. AT&T may add or remove access to the POPs used for the Extended Access Feature and/or the Connectivity Features (or change the web site on which they are identified), including adding or removing the access to POPs in an entire country or group of countries from time to time and without prior notice or liability to Customer.

A current list of the countries where the Connectivity Features are available is contained in the Client, as well as at http://info.attbusiness.net/wifi/abis/index.cfm?fuseaction=abis.availability. A current list of the Extended Access Feature countries and POPs (including what Region an Extended Access POP is located in) is available at http://info.attbusiness.net/e-access/abis/CountryList.xls.

If Customer or Users need access to the Extended Access Feature and the Connectivity Features for Intensive Use from a country where AT&T has an entity or a local service provider and makes the Service generally available to Customers in such country, Customer must obtain a local account ID and User ID from the AT&T entity in that country, provided that the Service is available to local Users with local User IDs in that country.

Pricing for the Extended Access and the Connectivity Features

Pricing for the Extended Access Feature and the Connectivity Features is detailed below, and is based on usage and the Region or Zone where a POP is located:

(i) Extended Access Feature POPs are currently divided into two Regions (North America & Region A, as set forth in the software based phone book), and charges are based on hourly usage in the Region in which an Extended Access Feature POP is located.

(ii) AT&T Wi-Fi HotSpots are currently divided into four Zones (Zone 1, 2, 3 and 4), as set forth in the software based phone book, and charges are based on hourly usage in the Zone in which a HotSpot is located.

(iii) AT&T Wired Ethernet POPs are currently divided into two Zones (Zone 1 and Zone 2), and the charges for the AT&T Wired Ethernet Feature are calculated based on usage within a defined, predetermined time period (Wired Ethernet Day) and do not vary based on the amount of usage that occurs during such time period.

AT&T may add Regions to the Extended Access Feature or the Connectivity Features and/or change a POP from one Region to another, from time to time and without prior notice to Customer. AT&T may change the pricing for the Extended Access Feature and the Connectivity Features and/or for the use of any POP from time to time upon ten (10) days notice (via posting to the Service Guide or otherwise).

In the event that Customer or Users access any POPs not authorized herein, and AT&T as a result incurs any charges from the provider of such POPs, AT&T may charge Customer for such unauthorized usage at a rate specified by AT&T.

The pricing for use of the Extended Access Feature and/or the Connectivity Features is in addition to hourly usage charges, as applicable to those Users registered to the Corporate Dial Base Plan or any other hourly usage plans, or in addition to the User ID monthly charge and excess usage charges, as applicable to Users registered to any monthly allocated hour plans, as the case may be. However, use of the Extended Access Feature and/or the Connectivity Features does not affect a monthly plan's allotted monthly hours.

Charges for the Extended Access Feature and/or the Connectivity Features may not be reflected on a Customer's invoice until several months after the usage.

FEATURE-SPECIFIC TERMS

Extended Access Feature

Customers appropriately registered in selected countries may utilize the Extended Access Feature while traveling outside the country of registration of their UserID.

Connectivity Features

The AT&T Wi-Fi Feature functions through broadcast radio wave transmissions between Customer's or a User's Unit and the nearest HotSpot. The AT&T Wired Ethernet Feature functions through a LAN established at a given location between Customer's or a User's Unit and a Wired Ethernet enabled POP. Use of Connectivity Features may allow others to gain unauthorized access to a Unit or monitor or intercept the data transmissions to or from the Unit.

AT&T Wi-Fi Feature

The AT&T Wi-Fi Feature provides access to the Service via selected HotSpots through AT&T's Affiliate, AT&T Global Communications Services Inc., to whom AT&T has assigned this portion of the Service. The AT&T Wi-Fi Feature allows U.S.-registered Customers of the Service to transport data between a properly configured Unit and the Service by connecting to designated HotSpots.

There are four Wi-Fi Zones, Zone 1, Zone 2, Zone 3 and Zone 4. Zone 1 is comprised of the U.S. non-AT&T Wi-Fi locations. Zone 2 is comprised of standard, non-AT&T owned Wi-Fi locations outside of the United States, Zone 3 is comprised of all of the U.S. owned Wi-Fi locations and Zone 4 is comprised of premium, non-AT&T owned WiFi locations outside the United States.

Please also see the section on Extended Access, which also applies to the Wi-Fi Feature. The AT&T Wi-Fi Feature works as follows: A User's Unit makes an initial connection by detecting a HotSpot via the 802.11 Wi-Fi card supplied by Customer or a User, and such User is then authenticated by AT&T's systems and connected to the Service. Access speeds for the Wi-Fi Feature will vary and are dependent on many factors, such as the type of Unit and equipment used by Customer or Users.

Customers appropriately registered in the United States may also access the Wi-Fi Feature while traveling outside the U.S. (in countries where HotSpots are available) through the use of a third party relationship that utilizes HotSpots from locally authorized ISPs. When the Wi-Fi Feature is provided via HotSpots that are owned and operated by non-AT&T Affiliated third party entities, AT&T is not responsible for the performance, interoperability or interconnection of or with such third party HotSpots. For a list of the countries where HotSpots are currently available, please go to http://info.attbusiness.net/wifi/abis/index.cfm?fuseaction=abis.availability.

The Wi-Fi Feature is not available to those customers that do not use the Client, and the Wi-Fi Feature may only be used with version 6.0 (or later) of the Client, which contains the proper interface for use with the Connectivity Features. A list of cities and HotSpots will be identified in the then current software-based phone book available from AT&T for use with the Wi-Fi Feature, which list may be updated from time to time without prior notice to Customer. AT&T does not warrant the availability of any HotSpots.

Service level objectives and agreements (SLAs) are not applicable to the Wi-Fi Feature. ISDN access is not currently available with the Wi-Fi Feature.

HotSpots are divided into four Zones (Zone 1, Zone 2, 3 and Zone 4). The charges associated with the HotSpot Zones are based on hourly usage of HotSpots and the Zone in which a HotSpot is located. AT&T may change a HotSpot from one Zone to another, or may add new HotSpot Zones from time to time and without prior notice to Customer. AT&T may also change the pricing for use of any HotSpot from time to time upon ten (10) days notice (via posting to the Service Guide or otherwise). The charges for use of the Wi-Fi Feature are in addition to hourly usage charges for the Service applicable to those Users registered to the corporate dial Base Plan and the monthly charge and excess usage charges for the Service applicable to Users registered to any monthly allocated hour plans, as the case may be.

Charges for the use, and the usage, of the Wi-Fi Feature do not affect a monthly plan's allotted monthly hours. Wi-Fi Feature charges may not be reflected on a Customer's invoice until several months after the usage. Wi-Fi Feature charges are billed on an hourly basis (rounded up to the nearest 1/100 of an hour) based on Wi-Fi Session length. The charges for the AT&T Wi-Fi Feature are listed at http://info.attbusiness.net/wifi/abis/index.cfm?fuseaction=abis.billing or any future web site AT&T may designate.

Customer is solely responsible for the following:

  1. the selection, purchase, programming, configuration and updating of any Unit used with the AT&T Wi-Fi Feature, including applying of management and security procedures Customer deems appropriate to protect Customer's or End User's information, such as application logon security and encryption of data
  2. the maintenance, monitoring, performance and compatibility of any Unit with the Connectivity Features

The performance of the AT&T Wi-Fi Feature may:

  1. degrade or fluctuate during a Wi-Fi session, based on the environmental or structural conditions of the HotSpot used by Customer or User;
  2. degrade or fluctuate during a Wi-Fi session as the Unit moves about within the coverage area of the HotSpot used by Customer or User; or

AT&T Wired Ethernet Feature

The AT&T Wired Ethernet Feature allows U.S.-registered AT&T Business Internet Corporate Dial Customers to access the Service using a properly configured Unit via Wired Ethernet Connections to AT&T Ethernet-enabled POPs. Wired Ethernet locations are divided into two zones. Zone 1 & 2. The charges associated with the Wired Ethernet locations are based on 24 hours of usage at a Wired Ethernet location and the Zone in which a Wired Ethernet location exists.

The AT&T Wired Ethernet Feature works as follows: A User's Unit makes an initial connection to an AT&T Ethernet-enabled POP through a Wired Ethernet Connection via a standard (802.3) wired Ethernet card and an appropriate Ethernet cable supplied by Customer or a User, and such User is then authenticated by AT&T's systems and connected to the Service. Access speeds for the Wired Ethernet Feature will vary and are dependent on many factors such as the type of Unit and equipment used by Customer or Users.

Customers appropriately registered in the United States may utilize the Wired Ethernet only at the locations where AT&T makes the Feature available. The Wired Ethernet Feature is only available via access points that are owned and operated by non-AT&T Affiliated third party entities. AT&T is not responsible for the performance, interoperability or interconnection of or with such third party access points. The Wired Ethernet Feature is not available to those customers that do not use the Client, and the Wired Ethernet Feature may only be used with version 6.0 (or later) of the Client, which contains the proper interface for use with the Connectivity Features. A list of cities and Ethernet-enabled POPs and Wired Ethernet access points will be identified in the then current software-based phone book available from AT&T for use with the Wired Ethernet Feature, which list may be updated from time to time without prior notice to Customer. AT&T does not warrant the availability of any Wired Ethernet access points.

Service level objectives and agreements (SLAs) are not applicable to the Wired Ethernet Feature. ISDN access is not currently available with the Wired Ethernet Feature.

The charges for the Wired Ethernet Feature are based on Wired Ethernet Days of usage for each Wired Ethernet POP for the Zone in which a Wired Ethernet POP is located, as identified in the software-based phone list provided for accessing the Feature. AT&T may change a Wired Ethernet POP from one Region to another, or may add Regions to the Wired Ethernet POPs from time to time and without prior notice to Customer. AT&T may also change the pricing for use of any Wired Ethernet POP from time to time upon ten (10) days notice (via posting to the Service Guide or otherwise). The charges for use of the Wired Ethernet Feature are in addition to hourly usage charges for the Service applicable to those Users registered to the corporate dial Base Plan and the monthly charge and excess usage charges for the Service applicable to Users registered to any monthly allocated hour plans, as the case may be. Charges for the use, and the usage, of the Wired Ethernet Feature do not affect a monthly plan's allotted monthly hours. Wired Ethernet Feature charges may not be reflected on a Customer's invoice until several months after the usage.

Wired Ethernet Feature charges are billed for usage in 24 hour increments for the Wired Ethernet Days Customer or User uses the Feature. Customer may connect repeatedly at the same Wired Ethernet POP within the first Wired Ethernet Day for the same initial charge. If the interval from the initial connection of the Unit at a Wired Ethernet POP to a subsequent connection at the same Wired Ethernet POP exceeds 24 hours, or the interval from the initial connection at a Wired Ethernet POP to a subsequent connection at the same Wired Ethernet POP is more than 24 hours, Customer will be charged a single fee for each Wired Ethernet Day in which Customer or User connects to or accesses the Wired Ethernet Feature at each such Wired Ethernet POP. The charges for the Wired Ethernet Feature are listed at http://info.attbusiness.net/wifi/abis/index.cfm?fuseaction=abis.billing or any future web site AT&T may designate.

Wireless Access Feature (EMEA Only)

The Wireless Access Feature allows Users to transport data between a properly configured remote user device and the Service across designated public mobile wireless data networks. Currently, General Packet Radio Service ("GPRS") is the only network available for use, in the countries specified in the country specific sections below. Public packet switched mobile wireless data networks that are interconnected to the AT&T global network are subject to change without prior notice. AT&T will provide a current list of such public packet switched mobile wireless data networks upon request. Customers are responsible for obtaining and paying for public packet switched mobile wireless services and for providing their own wireless modems which are compliant with the wireless network they are using with the Feature. Wireless modems are used in conjunction with the remote user workstation or other computing devices to establish a connection across the wireless bearer network directly to the Service. Charges for access to the Wireless Access Feature are based on a fixed surcharge per user per month.

The Wireless Access Feature may also be accessed when a User is permitted to roam outside of his "home network," i.e., the public packet switched mobile wireless data network that is interconnected to the AT&T Global Network. This form of access is not defined as "roaming" by AT&T, as the User traffic will currently be routed back to the AT&T Global Network via the interconnection to the "home network," in the same manner as traffic generated while connected in the home network. AT&T does not guarantee that this mode of access will be available from any specific network; customers are responsible for ascertaining the following: i) that the required roaming agreements are in place between the wireless networks that the User wishes to make use of, ii) that access to the AT&T Global Network is possible from any such wireless networks. Users are also responsible for obtaining and paying for any such roaming wireless services. AT&T does not apply any roaming surcharges for this type of usage by Users.

Wi-Fi Account Plans

Types of Wi- Fi Combination Plans ("Wi-Fi Combo Plans")

In the United States, the Wi-Fi Combo Plans listed below are available to all registered Users:

  1. The Standard Flat Rate Combo Plan
  2. The 50 Hour 2 & 4 Flat Rate Combo Plan
  3. The 50 Hour 4 & 8 Flat Rate Combo Plan
  4. The 100 Hour 5 & 10 Flat Rate Combo Plan
  5. The 150 Hour 6 & 12 Flat Rate Combo Plan
  6. The 150 Hour 8 & 14 Flat Rate
  7. The Unlimited Plan Flat Rate Plan
  8. The 23 Hour 6 & 12 Flat Rate Plan

Note: Surcharges and overage charges for usage in excess of plan amounts may also apply.

For Customers located outside of the United States, the 50 hour 2 & 4 Flat Rate Combo Plan is available as a standard plan. Other Flat Rate Combo Plans may be provided to such Customers on an individual case basis.

The details of each plan are more fully described below.

Standard Plan in the US - (150 Hour 3 & 6)

Under the Standard Wi-Fi Combo Plan, each User ID will have up to 150 hours of dial access, three (3) Wired Ethernet Days and six (6) Wi-Fi Sessions per month. The included dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 150 hours, each Wired Ethernet Day in excess of three (3) and/or each hour of Wi-Fi usage after six (6) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge rates plus applicable surcharges.

Standard Plan outside of the US (50 Hour 2 & 4 Plan)

Under this 50 Hour Wi-Fi Combo Plan, each User ID will have up to 50 hours of dial access, two (2) Wired Ethernet Days and four (4) Wi-Fi Sessions per month. The included dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 50 hours each Wired Ethernet Day in excess of two (2) and/or each hour of Wi-Fi usage in excess of four (4) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge rates plus applicable surcharges. If a User exceeds the number of hours allotted per plan, the User will be charged an overage charge.

50 Hour 4 & 8 Plan

Under this 50 Hour Wi-Fi Combo Plan, each User ID will have up to 50 hours of dial access, four (4) Wired Ethernet Days and eight (8) Wi-Fi Sessions per month. The included dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 50 hours, each Wired Ethernet Day in excess of four (4) and/or each hour of Wi-Fi usage in excess of eight (8) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge plus applicable surcharges.

100 Hour 5 & 10 Plan

Under this 100 Hour Wi-Fi Combo Plan, each User ID will have up to 100 hours of dial access, five (5) Wired Ethernet Days and ten (10) Wi-Fi Sessions per month. The included dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 100 hours, each Wired Ethernet Day in excess of five (5) and/or each hour of Wi-Fi usage in excess of ten (10) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge plus applicable surcharges.

150 Hour 6 & 12 Plan

Under this 150 Hour Wi-Fi Combo Plan, each User ID will have up to 150 hours of dial access, six (6) Wired Ethernet Days and twelve (12) Wi-Fi Sessions. The included dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 150 hours per User ID, each Wired Ethernet Day in excess of six (6) and/or each hour of Wi-Fi usage in excess of twelve (12) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge plus applicable surcharges.

150 Hour 8 & 14 Plan

Under this 150 Hour Wi-Fi Combo Plan, each User ID will have up to 150 hours of dial access, eight (8) Wired Ethernet Days and fourteen (14) Wi-Fi Sessions. The included hours of dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 150 hours, each Wired Ethernet Day in excess of eight (8) and/or each hour of Wi-Fi usage in excess of fourteen (14) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge plus applicable surcharges.

Unlimited Plan *(Not generally available to all Users) (Requires Special Approval on a case by case basis when Customer places Sales Order)

This plan Includes 150 hours of dial, unlimited Wired Ethernet days and unlimited Wi-Fi Sessions. Each Wired Ethernet day is a 24 hour period of time. Each Wi-Fi Session is measured from the User's log in to log out. A Session may not exceed 24 hours. The Customer is charged one flat rate per plan per month.

23 Hour 6 & 12 Flat Rate Plan

Under this 23 Hour Wi-Fi Combo Plan, each User ID will have up to 23 hours of dial access, six (6) Wired Ethernet Days and twelve (12) Wi-Fi Sessions. The included hours of dial access connect time (including total ISDN B channel connect time), Wired Ethernet Days and Wi-Fi Sessions per User ID are invoiced at a fixed monthly charge plus applicable surcharges. Each hour of dial access connect time in excess of 23 hours, each Wired Ethernet Day in excess of six (6) and/or each hour of Wi-Fi usage in excess of twelve (12) Wi-Fi Sessions for each User ID is invoiced at the applicable Overage Charge plus applicable surcharges.

AT&T Business Internet Services (Corporate Dial) DSL Feature (withdrawn from marketing)

The option of DSL (Digital Subscriber Line) connectivity is available to Users of the AT&T Business Internet Services (corporate dial) base plan.

The DSL feature provides a connection for Users that can deliver up to megabit effective data speeds over existing telephone wiring (availability and speed of service is reduced the farther the distance from the serving central office). DSL access is provisioned through the User's Local Exchange Carrier (LEC). The DSL Feature utilizes ADSL and IDSL access technologies. The customer availability of ADSL and IDSL bandwidths depends upon the distance the customer site is from the central office and availability from the serving LEC and is subject to change without prior notice.

ADSL (Asymmetric Digital Subscriber Line) provides asymmetric bandwidth to the customer premises. The downstream bandwidth (to the customer from the network) is larger than the upstream bandwidth (to the network from the customer). IDSL (ISDN Digital Subscriber Line) provides up to 144 kbps effective transfer rates in each direction (similar to ISDN) and can be supported at greater distances than ADSL from the central office.

AT&T provides AT&T Global Network Client software as part of the Service. The AT&T Global Network Client supports attachment to AT&T's global network and the DSL feature when used on an appropriately configured workstation. Each IP packet that is received by the AT&T Global Network Client at the User's workstation is examined to determine if it is unsolicited and if so, it is discarded. An algorithm combining a rolling list of recently contacted remote hosts determines a packet's solicitation status.

AT&T arranges the installation, which includes the provision of the compatible DSL router (warranted by manufacturer), line installation and assistance with the installation of client software with an end to end test of connectivity. Optionally, the installation may include the installation of a NIC card to enable the User's PC to connect to the DSL router. The customer will own the installed DSL router and is responsible for its maintenance. AT&T is responsible for managing the DSL line connection and working with the providing carrier in the event of a line connection problem.

The optional DSL charges are set forth in Table 2. DSL feature charges are in addition to other applicable base plan charges, if any. DSL feature charges are not eligible for allowance or discount. The DSL feature incurs a one-time installation charge which is based on the provisioning carrier and on whether or not the NIC card installation is included.

The monthly DSL line charge is based on the provisioning carrier and the type of the line connection, ADSL or IDSL. The monthly DSL line charge is proratable. The monthly DSL line charge is in lieu of the base plan hourly charge for DSL connectivity. User connectivity, other than DSL connectivity, will incur the base plan hourly charge.

Billing for the AT&T Business Internet Service

Corporate dial - Charges

AT&T Business Internet Services (corporate dial) is available per the appropriate country schedule of charges and charge plan options in that country. Depending upon the plan selected upon registration, customers of AT&T Business Internet Services corporate dial may incur:

  • a one-time registration charge per User ID
  • a monthly per User ID charge for local dial access (exclusive of ISDN local dial access) up to a set number of hours
  • a per hour prime and non-prime time usage charge for local dial access
  • a per hour prime and non-prime time usage charge for ISDN local dial access
  • a per hour prime and non-prime time usage surcharge for ISDN local dial access
  • a per hour prime and non-prime time surcharge to the local or ISDN dial access charge for "800" number (toll free) usage
  • a monthly mailbox charge per User ID
  • a mail domain setup charge, as applicable
  • a per hour out of region roaming charge
  • a monthly personal web space charge per User ID

The dial access charges which apply to AT&T Business Internet Services (corporate dial) are on a "per access" basis. We measure "per access" hourly charges from the start of the telephone connection to AT&T's network until the telephone connection is terminated. A single charge is incurred for each physical connection, regardless of the number of concurrent logical sessions that are within one physical session.

All orders, including the initial order set forth in the Pricing Schedule, must undergo an AT&T technical review before they are accepted by AT&T for implementation. AT&T shall have the right to reject any orders from Customer, including the initial order set forth in the Pricing Schedule, which are not approved under the then current AT&T technical assurance process for such orders. AT&T may not implement the Service for any orders where the information supplied for such order is inaccurate or incomplete or where Customer's order is not approved under AT&T's technical assurance process.

In each country where Service is ordered and provided, AT&T will send invoices to Customer or its in-country Affiliate at the address identified in the Agreement, except as otherwise provided under the standard AT&T billing processes in effect in each country. Customer agrees that AT&T may require Customer to retrieve invoices from a designated web site as this may be described in the Service Guide, and Customer agrees to do so in such event.

In some countries, AT&T may require payment in advance for the Service, as specified in the Additional Terms and Conditions Section below, for the countries mentioned therein.

Billing for the service is prorated beginning on the Service Activation Date, and is represented on the billing invoice for new Customers. Billing does not begin on the first of the month for new Customers unless it is the same date as the Service Activation Date. Billing at termination is not pro-rated. Billable Service features that are usage-based (i.e. additional hours, extended access, roaming, etc.) are billed in arrears.

Service Activation Date

The Service Activation Date shall occur as of the earlier of the following events: (i) the date that each Service Component is enabled for Customer or User use, or (ii) the date that Customer or User makes use of a Service Component. Furthermore, initial orders in a country must be in writing, but subsequent orders in a country may be communicated to AT&T by e-mail or fax.

Billing for any Service Component will begin on the Service Activation Date of such Service Component. However, if Customer's actions or omissions cause a delay of the Service Activation Date, billing will begin on the day after the Scheduled Service Activation Date for such Service.

Installation charges/one time charges are incurred as of the earlier of the date when (i) AT&T begins billing for the Service Component or (ii) cancellation of the order.

For each invoicing address, Customer must have a separate activity account and invoice account. An activity account is an alphanumeric identification used to identify Customer for the placement of Customer's orders and for the use of the Services. An invoice account is an alphanumeric identification used to control Customer's invoicing.

Detailed Example of Billing For Intermediate and Enterprise Plans

Example - (1) users connecting via a local dial access connection during the first 150 hours will not incur any additional charges; (2) users connecting via an ISDN local dial access connection during the first 150 hours will incur the ISDN local dial access surcharge per ISDN B channel in addition to the fixed monthly charge; (3) users connecting via a local dial access connection after the first 150 hours will incur the local dial access charge for each additional hour in addition to the fixed monthly charge; (4) users connecting via an ISDN local dial access connection after the first 150 hours will incur, per ISDN B channel, the local dial access charge plus the ISDN local dial access surcharge for each additional hour in addition to the fixed monthly charge; (5) users connecting via an ISDN "800" number (toll free) will incur both the ISDN local dial access surcharge and the ISDN "800" number dial access surcharge in addition to the fixed monthly charge and in addition to the local dial access charge for connect time after the first 150 hours. The out of region roaming surcharge is in addition to all other applicable charges and surcharges. Under this plan there is no User ID registration charge and no monthly mailbox charge.

Detailed Example of Billing for the Account Cap Plan

Example - (1) accounts connecting via a local dial access connection for less than the account allocation (23 hours multiplied by the number of registered users at the beginning of the month) will not incur any additional charges; (2) accounts connecting via an ISDN local dial access connection for less than the account allocation will incur the ISDN local dial access surcharge per hour of ISDN B channel in addition to the fixed monthly charge per user; (3) accounts connecting via a local dial access connection for more than the account allocation will incur the local dial access charge for each additional hour in addition to the fixed monthly charge per user; (4) accounts connecting via an ISDN local dial access connection above the account allocation hours will incur, per ISDN B channel hour, the local dial access charge plus the ISDN local dial access surcharge in addition to the fixed monthly charge per user; (5) accounts connecting via an ISDN "800" number (toll free) will incur both the ISDN local dial access surcharge and the ISDN "800" number dial access surcharge per hour in addition to the fixed monthly charge per user and in addition to the local dial access charge for connect time above the account allocation of hours. The out of region roaming surcharge is in addition to all other applicable charges and surcharges. Under this plan there is no User ID monthly mailbox charge.

Detailed Example of ISDN charges

Using only one B channel for an hour would incur charges for one hour of connect time. If two B channels are used at the same time, whether separately or bundled together for one hour, then the charges incurred would be for two hours of connect time, one hour for each active B channel.
